Terms of Service

These Terms of Service are the agreement between you and Hearth for access to Hearth’s AI companion through iMessage, our website, and any related services.
Please read these terms carefully. By texting Hearth, visiting a feature that requires acceptance of these terms, or otherwise using the Service, you agree to these Terms of Service (the “Terms”). If you do not agree, do not use Hearth.
Our Privacy Policy explains how we handle personal information. Our Terms of Use explain the conduct and content rules that apply when using Hearth. Both are incorporated into these Terms.
1. About Hearth
Hearth is an AI-powered conversational companion designed to offer reflection, encouragement, and everyday conversation through messaging services such as iMessage.
Hearth is an automated system, not a human being. Responses are generated with artificial intelligence and may be inaccurate, incomplete, inappropriate, or unexpected. Hearth does not guarantee that it will understand every message or remember every detail.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding agreement to use Hearth. By using the Service, you represent that:
- the information you provide is accurate and belongs to you;
- you are not prohibited by law from using the Service;
- you will comply with these Terms and all applicable laws; and
- you have not previously been suspended from Hearth unless we have given you written permission to return.
If you use Hearth on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Your Hearth profile and messages
Your phone number or messaging identifier may be used to recognize you and maintain conversation continuity. You are responsible for:
- controlling access to your phone, Apple account, and messaging account;
- keeping your device and account secure;
- promptly notifying us if you suspect unauthorized access; and
- all activity that occurs through your messaging identity, unless caused by Hearth’s failure to use reasonable security measures.
Carrier, data, messaging, and device charges may apply. Your relationship with your wireless carrier, Apple, or another messaging provider is separate from your relationship with Hearth.
4. AI-generated responses and important limitations
Hearth is designed for general companionship and informational conversation. It is not a licensed therapist, doctor, lawyer, financial adviser, emergency service, or other professional.
Do not rely on Hearth as a substitute for professional judgment or for decisions involving health, safety, legal rights, finances, employment, housing, or other high-impact matters. You are responsible for evaluating responses and deciding whether to act on them.
Hearth does not continuously monitor conversations and cannot reliably identify or respond to every crisis. If you believe you or another person may be in immediate danger, contact local emergency services or a qualified crisis resource.
5. Your content
“Your Content” means messages, prompts, photos, files, voice notes, feedback, and other material you send to or through Hearth.
You retain ownership of Your Content. You give Hearth a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, display, adapt, and otherwise use Your Content only as reasonably necessary to:
- provide and personalize the Service;
- generate responses and maintain conversation context;
- protect, troubleshoot, and improve Hearth;
- comply with law and enforce these Terms; and
- carry out any additional purpose you authorize.
This license lasts for as long as necessary to provide the Service and meet the retention needs described in our Privacy Policy.
You represent that you have the rights needed to submit Your Content and that its submission and use as described in these Terms will not violate another person’s rights or any law.
6. Acceptable use
You must follow our Terms of Use. Among other things, you may not use Hearth to harm others, facilitate illegal activity, exploit minors, distribute malware, evade safeguards, impersonate another person, or generate content that infringes another person’s rights.
You may use Hearth for personal, non-commercial purposes unless we agree otherwise in writing. You may not resell, sublicense, scrape, systematically extract, reverse engineer, or use the Service to build or train a competing product except where such restrictions are prohibited by law.
7. Hearth content and intellectual property
The Service—including software, design, branding, interfaces, models, features, documentation, and content supplied by Hearth—is owned by Hearth or its licensors and protected by intellectual property laws.
Subject to these Terms, Hearth grants you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the Service for its intended purpose.
AI-generated responses may not be unique, and other users may receive similar responses. To the extent Hearth owns rights in a response generated specifically for you, Hearth permits you to use that response for personal and lawful purposes. This permission does not grant rights in Hearth’s software, branding, models, or third-party materials.
Feedback is welcome. If you send suggestions or ideas, you allow us to use them without restriction or compensation, but we are not required to do so.
8. Third-party services
Hearth relies on third-party services, including communications platforms, cloud infrastructure, and AI technology providers. Their services may be governed by separate terms and may become unavailable or change without notice.
Apple and iMessage are trademarks of Apple Inc. Hearth is not sponsored by, endorsed by, or affiliated with Apple Inc.
We are not responsible for third-party services, websites, or content that Hearth may reference or link to. Review the applicable third-party terms before using them.
9. Paid features
Hearth may offer paid features or subscriptions in the future. If you purchase one:
- the price, billing period, renewal terms, and included features will be disclosed before purchase;
- taxes and payment-provider charges may apply;
- subscriptions may renew automatically if disclosed at checkout;
- cancellation takes effect according to the terms shown at purchase; and
- refunds are provided as required by law and the applicable purchase terms.
Purchases made through Apple or another third-party platform are also subject to that platform’s billing and refund rules.
10. Service changes and availability
We are continually developing Hearth. We may add, modify, suspend, or remove features, impose usage limits, or discontinue some or all of the Service.
We aim to keep Hearth available, but we do not guarantee uninterrupted or error-free operation. Maintenance, provider outages, security events, legal requirements, and circumstances outside our control may affect availability.
Where reasonably possible, we will provide notice before discontinuing a material paid feature.
11. Suspension and termination
You may stop using Hearth at any time. You can block the conversation through your messaging app and may request deletion as described in our Privacy Policy.
We may limit, suspend, or terminate access if we reasonably believe:
- you violated these Terms or the Terms of Use;
- your use creates risk or possible legal exposure;
- suspension is necessary to protect Hearth, users, or others;
- we are required to do so by law or a service provider; or
- continuing to provide the Service is no longer commercially or technically feasible.
Where appropriate, we will provide notice and an opportunity to appeal. We may act immediately in urgent safety, security, fraud, or legal situations.
Sections that by their nature should survive termination—including intellectual property, disclaimers, limitations of liability, indemnity, and dispute provisions—will survive.
12. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Hearth and its licensors disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and quiet enjoyment.
We do not warrant that:
- Hearth’s responses will be accurate, safe, complete, useful, or suitable for your circumstances;
- the Service will meet your expectations or always be available;
- defects or errors will be corrected; or
- the Service will be free from harmful components or unauthorized access.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, Hearth and its directors, employees, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, opportunities, or business interruption arising from or related to the Service.
To the fullest extent permitted by law, Hearth’s total liability for all claims arising from or related to the Service will not exceed the greater of:
- the amount you paid Hearth for the Service during the 12 months before the event giving rise to the claim; or
- USD $100.
These limitations apply regardless of the legal theory and even if Hearth was advised that damages were possible. They do not limit liability that cannot lawfully be limited, including liability for fraud, willful misconduct, or certain personal injury claims.
14. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Hearth and its affiliates, personnel, licensors, and service providers from claims, damages, losses, and expenses—including reasonable legal fees—arising from:
- Your Content;
- your misuse of the Service;
- your violation of these Terms or law; or
- your violation of another person’s rights.
This obligation does not apply to the extent a claim results from Hearth’s own unlawful conduct.
15. Governing law and disputes
Before filing a formal claim, you and Hearth agree to try to resolve the dispute informally for at least 30 days. Send a written description of the dispute and the requested resolution to legal@hearth.ai.
Except where the law in your place of residence requires otherwise, these Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. You and Hearth agree that disputes may be brought in the state or federal courts located in Delaware, and each party consents to those courts’ jurisdiction.
Nothing in these Terms prevents either party from seeking urgent injunctive relief, filing an eligible claim in small-claims court, or exercising rights that cannot be waived under applicable consumer law.
16. Changes to these Terms
We may update these Terms as Hearth changes. We will post the revised Terms with an updated effective date. If a change materially affects your rights, we will provide additional notice where required.
Your continued use of Hearth after revised Terms take effect means you accept them. If you do not agree to an update, you must stop using the Service.
17. General terms
These Terms, the Privacy Policy, the Terms of Use, and any purchase-specific terms form the entire agreement between you and Hearth regarding the Service.
If a provision is unenforceable, it will be modified only as much as necessary, and the remaining provisions will stay in effect. Hearth’s failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; Hearth may transfer them as part of a reorganization, financing, merger, or sale of the Service.
Headings are for convenience only. The word “including” means “including without limitation.”
